What is ITAR?

Violating ITAR is a serious crime. Night vision and thermal devices utilize protected technology that give Military and Law Enforcement Professionals an advantage in the battlefield, keep our borders secure, and our communities safe. We ask that our customers help us safeguard this technology by owning and using it responsibly. Below is some basic information about our ITAR policy and information about exporting and traveling with your night vision or thermal device. 

Night vision and thermal systems are controlled by the US Department of State under the International Traffic in Arms Regulations (ITAR). Upon receipt of these items through purchase, loan, or gift the receiver agrees that he/she will not sell, resell, divert, export, reexport, transfer, trans-ship or other wise dispose of the item(s) to or in any other country outside the United States without securing a properly executed export license or agreement from the appropriate U.S. governmental agency. Additionally, no receiver shall make available to a Foreign Person* (within or outside the United States) the technical data, technology, or manufacturing know-how to allow Foreign Persons to access such items within the United States. 

*Foreign person means any natural person who is not a lawful permanent resident as defined by 8 U.S.C. 1101(a)(20) or who is not a protected individual as defined by 8 U.S.C. 1324b(a)(3). It also means any foreign corporation, business association, partnership, trust, society or any other entity or group that is not incorporated or organized to do business in the United States, as well as international organizations, foreign governments and any agency or subdivision of foreign governments (e.g., diplomatic missions).

For the sake of simplicity, our products are only available for sale to US citizens located in the US and are not available to non-citizens regardless of location. We will only ship within the continental US. 

Can I export night vision?

In order to export night vision you would need approval from the U.S. State Department. To do so, without approval from the Government, is considered a Federal Offense and resulting in the possibility of sentencing to federal prison.

Can I travel outside of the country with my night vision or thermal device?

Export of Night Vision Devices is illegal under ITAR without prior written approval from the U.S. Government. This includes travel which means you cannot take a night vision device with you if you leave the country. It is a violation of ITAR to transfer a night vision device out of the country by plane (checked or carry-on luggage) train, boat, or automobile. This policy applies to all civilian and law enforcement personnel.
